Terms

Terms of service

In force from 25 October 2026

1. Who runs the service

The tuned service (the “Service”) is run by Zdzisław Bela (the “Provider”). Contact: host@tunedparty.com.

These terms set out the rules for using the Service and are the terms referred to in Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means. By using the Service you accept these terms.

2. What the Service offers

The Provider offers the following services:

  • The game: a quiz for two people, each answering the same question on their own device, in a room opened with a code or a link.
  • AI host: in selected modes, the questions and the comments on the answers are generated by an artificial intelligence model.
  • Account: optional; it lets you save the history of your games. You can play without an account.

3. Technical requirements

  • a device with internet access,
  • an up-to-date web browser with JavaScript and browser storage enabled,
  • to create an account: an email address where you can receive a sign-in code.

4. Who may use the Service

The Service is for people aged 16 or over. A younger person may use the Service only with the consent of a parent or legal guardian. Only people aged 18 or over play with the AI host; younger people play the rooms without the AI.

5. Rules of use

When using the Service, you must not:

  • enter content that is unlawful, offensive or infringes other people’s rights (this includes your name and your own game topic),
  • share other people’s data in the game, especially data about their health, views or intimate life, without that person’s consent,
  • disrupt the Service or try to access other people’s data.

The Provider may block access to the Service or delete the account of a person who flagrantly breaks these rules.

6. Account

  1. You create an account by entering your email address and the one-time code sent to it. The account agreement is concluded for an indefinite period.
  2. You can delete the account at any time by sending a request to host@tunedparty.com from the email address linked to the account. Deleting the account also deletes the game history.
  3. The Provider may terminate the account agreement for important reasons (e.g. a breach of these terms or the closure of the Service) with 14 days’ notice, and with immediate effect in the case of a flagrant breach of these terms.

7. AI-generated content

The AI host’s questions and comments are generated automatically. They are for entertainment only, may be inaccurate or wide of the mark, and are not advice (e.g. psychological or relationship advice).

The AI narrator’s voice is synthetic: it is generated by AI and does not imitate any real person. The music on Tuned Party Radio is also made with AI.

8. Liability

The Provider takes care that the Service works properly but does not guarantee that it will run without interruption. Interruptions may happen, e.g. because of maintenance or a supplier’s outage. This does not limit the rights consumers have under the law.

9. Complaints

Complaints can be sent to host@tunedparty.com. Please describe the problem and give an email address for the reply. The Provider responds to a complaint within 14 days of receiving it.

Consumers in Poland may also use the help of a municipal or district consumer ombudsman.

10. Personal data

How personal data is processed is described in the Privacy policy.

11. Changes to the terms and final provisions

  1. The Provider may change these terms for important reasons, e.g. a change in the law or in the scope of the services. People with an account will be informed of a change at least 14 days in advance. Anyone who does not accept the changes may delete their account within that time.
  2. Matters not covered here are governed by Polish law. This does not deprive consumers of the protection granted by the mandatory provisions of the law of their country.

12. Companies and event organizers

This section applies to companies and organisations that use the tools for companies (polls, the waiting list, event sign-ups; the “Organizer”). The Organizer accepts it in the panel before publishing its first event, together with the data processing agreement. We store the time of acceptance, the account and the version of the text.

  1. Only a tool. The Provider supplies a sign-up tool. It is not the organizer of the event and not a party to the contract between the Organizer and a participant. A participant makes the contract to take part in the event with the Organizer alone, on the terms of the Organizer’s own rules.
  2. The Organizer’s responsibility. The Organizer alone is responsible for its event, in particular for: its lawfulness and any required permits, the safety of participants, insurance, the description, prices, taking payments, refunds, cancelling or changing the event, taxes, its own terms and consumer information, and claims of participants and third parties connected with the event.
  3. Money. The Provider does not take, hold or pass on payments for events. Payment details the Organizer enters (e.g. a bank account number) are its content; the “Paid” mark in the panel is the Organizer’s note.
  4. No guaranteed turnout. The Provider does not guarantee the number of sign-ups, that people who signed up will come, or that every email reaches its recipient. The Organizer has the list of sign-ups in the panel and can download it.
  5. Content and removal. The Organizer is responsible for the content it publishes. The Provider may hide or remove an event or block an account when the event or content breaks the law, the rights of others or these terms, and tells the Organizer by email with the reason (Art. 17 of the Digital Services Act, DSA). Reports of illegal content go to host@tunedparty.com.
  6. Indemnity. The Organizer indemnifies the Provider and covers reasonable costs, including the costs of defence, when a participant or a third party brings a claim against the Provider connected with the Organizer’s event or content. The Provider tells the Organizer about such a claim without delay.
  7. Limit of liability. The Provider’s liability to the Organizer is limited to the fees the Organizer paid the Provider in the 12 months before the event giving rise to it; on the free plan the Provider is not liable for lost profits or for damage caused by interruptions of the Service. The limit does not apply to damage caused intentionally or where the law does not allow it.
  8. Personal data. The Organizer is the controller of the data of people who sign up for its events, wait in its queue or answer its polls. The Provider processes it on the Organizer’s behalf (Art. 28 GDPR); for sign-ups and the queue the data processing agreement sets out the rules.
